Quando si parla di porte automatiche si fa riferimento a un variegato panorama di dispositivi che comprende cancelli basculanti, battente e scorrevoli, sbarre, sezionali, a libro, a catena, e ovviamente le porte automatiche. Lo scenario normativo, che per definizione fa riferimento a questo universo semplicemente con il termine porta automatica, è piuttosto articolato. Iniziamo dal primo aspetto tecnico-legislativo, rappresentato dal decreto ministeriale 37/08.
D.M. 37/08
Il decreto ministeriale 37/08, che ha sostituito la ex Legge 46/90, regolamenta l’installazione e/o la manutenzione della porta automatica, e i requisiti tecnico-professionali che la ditta installatrice deve possedere per svolgere questo compito. Il committente-condominio prima di incaricare i lavori di manutenzione o installazione deve verificare che la ditta candidata sia in possesso della relativa abilitazione sui cancelli automatici, deve controllare che sulla visura camerale tra le abilitazioni sia presente la seguente dicitura evidenziata: a) (…) nonché gli impianti per l’automazione di porte, cancelli e barriere; questo è il caso di una ditta installatrice abilitata al DM 37/08 dopo il 2008. Nel caso di azienda che nel 2008 era già abilitata ai lavori sui cancelli automatici ci deve essere invece la seguente dicitura: b) (…) gli impianti radiotelevisivi ed elettronici in genere, le antenne e gli impianti di protezione da scariche atmosferiche; La ditta installatrice a fine lavoro dovrà rilasciare una dichiarazione di conformità dove descrive l’intervento fatto e le relative norme di riferimento: Cei 64-08 o Cei 64-50, ma anche e soprattutto la Uni 12453.
Regolamento UE n. 305/2011
Le ante dell’automazione sono soggette al Regolamento UE n. 305/2011, detto «regolamento dei prodotti da costruzione». Ovvero, tutte le ante prodotte in serie devono essere corredate dalla marcatura “CE” ai sensi della Uni En 13241-1 e la relativa dichiarazione prestazionale. Ma lo stesso regolamento ha subito delle deroghe relative alla redazione della dichiarazione di prestazione (articolo 5), secondo cui: «In deroga all’articolo 4, paragrafo 1, (…) il fabbricante può, all’atto di immettere sul mercato un prodotto da costruzione che rientra nell’ambito di applicazione di una norma armonizzata, astenersi dal redigere una dichiarazione di prestazione qualora: il prodotto da costruzione sia fabbricato in un unico esemplare o su specifica del committente in un processo non in serie a seguito di una specifica ordinazione e installato in una singola e identificata opera di costruzione da parte di un fabbricante che è responsabile della sicurezza dell’incorporazione del prodotto da costruzione nelle opere di costruzione (…)». Si evidenzia, quindi, che ogni componente (anta) che risulti unico e non prodotto in serie può non avere la marcatura Ce e la dichiarazione da parte del fabbricante, ma è comunque opportuno che lo stesso sia accompagnato da una dichiarazione che ne attesti la caratteristiche tecniche e fisiche.
Direttiva Macchine 2006/42/Ce
La direttiva Macchine 2006/42/Ce, recepita dal D. Lgs 17/2010 il quale rende la sua applicazione obbligatoria per legge anche in modo retroattivo, ha come obiettivo quello di far produrre e far circolare macchine sicure su tutto il territorio della comunità europea, facendo applicare e rispettare le norme tecniche specifiche delle macchine. Nel caso dei cancelli automatici si rimanda in modo particolare alle Uni En 12453 e Uni En 12445. Da febbraio 2018, tuttavia, trova applicazione solo la uni En 12453 che ha inglobato la 12455. Con questa nuova norma si sono colmate alcune mancanze tecniche precedenti che non facevano rispettare tutti i requisiti di sicurezza imposti dalla Direttiva stessa. Una delle definizioni fondamentali della Direttiva Macchine da tenere presente è che l’installazione che motorizza una porta o un cancello ha gli stessi obblighi del costruttore di una macchina, cioè diventa esso stesso il costruttore della macchina, il quale deve indicare il periodo di controllo manutentivo per mantenere alto il livello di sicurezza e individuare le anomalie della macchina in tempi brevi. Come costruttore della macchina, l’installatore deve adempiere ai seguenti obblighi:
a) Predisporre il fascicolo tecnico composto da: Disegno complessivo, Schema circuiti elettrici, Manuale di istruzione per l’uso in sicurezza dell’automazione, Registro manutenzione, Dichiarazione Ce di conformità, Analisi dei rischi, Targa Ce, Documento di modifica/Trasformazione, Dichiarazione ai sensi della Uni En 13241-1;
b) Applicare sulla chiusura motorizzata la marcatura Ce. L’emissione della dichiarazione Ce di conformità, da parte dell’installatore, attesta la rispondenza della macchina alle norme tecniche in vigore e il soddisfacimento dei Res (requisiti di sicurezza). In un certo senso rappresenta il collaudo della macchina, da non confondere con il certificato di collaudo che viene rilasciato obbligatoriamente nel caso di regolamento specifico come per lavori pubblici o richiesto dal committente e viene firmato da un professionista che è indipendente dai lavori di installazione e progettazione. La macchina deve essere sottoposta a regolare manutenzione e a verifica periodica come prevede il D. Lgs 17/2010. Tale decreto trova applicazione anche in modo retroattivo, ovvero impone la messa in sicurezza di tutte le macchine già esistenti alla data della sua applicazione. E che cosa fare nel caso del cancello automatico già esistente? Occorre ricostruire il fascicolo tecnico e i diversi documenti che lo compongono, affidando l’incarico a figure competenti.
